The basics of divorce, it is important to understand some divorce basics before you speak to a divorce attorney. Divorce can become convoluted. What you will learn quickly that it can be the law, but not really always make good common sense to the basic average Joe. Divorce is an agonizing decision to make, but the aftermath can be just as difficult to deal with. It will take a while to work through the “stuff” that goes along with it, even after the legal issues are over. It goes without saying your life is about to change on many levels and you may find yourself walking on eggshells in unfamiliar territory. The first step to getting on with your life is to give yourself a break by realizing there’s no point in rushing through the process. Why put that kind of pressure on yourself? When you understand the divorce basics’s and the divorce process, things are less difficult. It is a good thing you are spending time looking into this and taking time to review your options. I see so many people come to my office with stories about their divorce that just didn’t have to be. I see smart people in tough situations and things got worse not better because they made decisions without enough good information  With some good information they could have made decisions that would’ve made their life simpler and their divorce is less stressful. After many years of family law practice I know that when people know what to expect, they can plan. Not knowing about the family law legal system, the process, divorce attorneys, only makes divorce already hard: harder.

Hi, I I’m Paul Staley. You’re considering getting divorce of the several things are going to need to know. The filing fee in San Diego is $350. It can actually be different in other counties. It takes six months from the date that the other spouse was served with the papers before your marriage can legally end. Now, keep in mind, that is not automatic. You actually have to do some things in between at six months to make sure that you get a judgment that results in a divorce. So during that six months you have some homework to do. You’re going to need to gather together the documents that help you analyze what’s the value of stuff; what’s mine, what’s his or hers –the other spouse–and what’s ours. You probably already know that California, being a community property state, means that whatever is ours — by that I mean your’s in your spouse’s –gets evenly divided. That’s the ordinary rule. There are also rules for determining what’s yours – what’s the other spouse’s. And so those are exceptions to that general community property rule. For example, if you received an inheritance, whether or not it was during the marriage, that’s yours. Same deal if it came to your spouse — that inheritance would be his or hers. So that just give you one example of one of the rules that helps you figure out what’s mine, his or hers, or ours. Moving along. Some of these values can be pretty easily identified. Bank statements for example. Appraisals of real estate. Blue Book printouts of value of your vehicles. Those are pretty easy to identify. The more difficult kinds of property: usually retirement plans, so you’re going to need some expert help with that typically.
